Butler County Common Pleas Judge Andrew Nastoff is resigning from the bench Aug. 2 to move out of state with his wife and children.

Nastoff, in a prepared statement sent to the press, said his wife’s job promotion is the reason for the move.

Nastoff has been a common pleas judge for more than eight years and is currently the administrative judge for Butler County.

Before taking the bench he worked as an assistant prosecutor and defense attorney.

Co-workers: Fire Butler Court ‘bully’ court employee

Two co-workers of a Butler County court employee blasted in a report last week for bullying others while having an extramarital affair with a judge wonder why she hasn’t been fired.

Last week, Reynoldsburg attorney Scott Warrick,delivered a stinging report on Jennifer Olivier’s allegations of sexual harassment, sexual discrimination and retaliation after Common Pleas Court Judge Michael Sage ended their nine-year affair. Warrick suggested in the report that Olivier, bolstered by her relationship with the judge, was the workplace bully and wrote her conduct should “not be allowed to continue for one more hour.”

Bailiff Christine Jones and Judicial Assistant Shirley Lakes – both employees working under Sage – seconded that sentiment and asked the judges, in a Monday email to The Enquirer, to get rid of her.

Warrick “noted several violations of our employee handbook that would mean immediate termination for any other employee,” their email read.

When contacted Monday, both Jones and Lakes refused further comment.

They also criticized several judges for continuing to allow Olivier to work with those she accused of wrongdoing but who were exonerated by Warrick’s investigation.

“In the aftermath of the release of the report, Judge (Charles) Pater has issued a statement that says we have done nothing wrong,” Jones and Lakes wrote in the email.

“Although we appreciate that astute observation, Pater and three of the other judges ignored Mr. Warrick’s recommendation that Ms. Olivier was the problem and that her behavior should not be tolerated ‘one more hour.’ ”

Neither Pater nor Court Administrator Gary Yates would comment about the email.

The email states Olivier won’t be disciplined because such action would appear to be retaliation for her complaints.

“(N)ot only is she still employed by the county, but we are still required to work with somebody who has made these slanderous accusations against us,” the email by Jones and Lakes noted.

Olivier was a court reporter, taking electronic dictation of court proceedings, when she delivered a January letter to Judge Michael Sage who, a month earlier, ended their nine-year affair. Both Sage and Olivier have spouses.

She didn’t return Monday calls.

Her letter noted she was being shunned and retaliated against because of the break-up. The report, though, found Olivier used her relationship with and connection to the judge to bully other employees and create a hostile work environment. She also wanted $350,000 to settle her allegations.

While Butler County Judge Michael Sage had an extramarital affair with a court employee, an investigation concluded today he didn’t retaliate against or bully the woman as she alleged.

Sage’s accuser, Jennifer Olivier, in fact, was deemed to have been “the bully” in their work environment, the report found.

“What Ms. Olivier seems to forget though all of this is that she simply does not have clean hands here. Ms. Olivier is the other woman,” Reynoldsburg attorney Scott Warrick wrote in today’s report.

“Where I see Judge Sage experiencing a great deal of embarrassment, I do not see that same response in Ms. Olivier.”

Warrick was hired after Olivier, a court reporter, made allegations that the judge was bullying her – and encouraging other courthouse workers also to bully her – after their 9-year extramarital affair ended in December.

Warrick recommended no discipline for the judge based on her allegations. Instead, he said Olivier’s actions created the hostile work environment.

“If people treat her differently because they know of this affair, which I do not believe is happening here, there is nothing illegal about that,” Warrick wrote.

“There is nothing illegal about treating someone differently because you find out that person was having an affair with a married man. However, I do not believe that is why Ms. Olivier is being treated the way she is at the court.

“In short, I see Ms. Olivier as the bully – and this conduct must not be allowed to continue for one more hour.”

Lakota educators honored – The Community Foundation of West Chester/Liberty recently honored two educators awarding each of them its Lakota Educator of Excellence Award. Jenny Haynes, a second grade teacher at Woodland Elementary, and Tim Shaffer, assistant principal at Lakota West High School, received the awards and were selected from nominations received from peers, parents and students in the community.

AK Steel posts $11.8 million first-quarter loss – West-Chester based AK Steel posted an $11.8 million first-quarter loss last Tuesday with lower shipments cutting into sales. The loss amounted to 11 cents per share. During the same period last year, the company had a profit of $8.7 million, or 8 cents per share. The company said that it expects to post a profit for the second quarter, but didn’t release specifics.

Jack in the Box breaks ground and names second location – A spokesperson with Jack in the Box said that it has started construction on its first Ohio location last week. Furthermore, the spokesperson also announced a second Cincinnati location for the fast food chain. Brian Luscomb of Jack in the Box said the company began construction in West Chester at 7425 Tylersville Road, which is off I-75 in an old gas station lot that is directly next to a Long John Silver’s.

The junior suffered an injury this fall, but has worked hard to get healthy and has been awarded with a lot of attention from college football coaches.

West Chester announces dates for nature programs – West Chester Township recently announced the dates for 2012 sessions of its Nature Basket and the WOLF programs. Each program is geared to teaching children about nature and the environment. All nature programs are offered free to the community, but class size may be limited.

Butler County judge faces sexual harassment complaint

A court reporter has filed a complaint against a Butler County common pleas judge saying he retaliated against her after their 9-year extra-marital affair ended when his wife found out in December.

Jennifer Olivier said Judge Michael Sage, who has been on the bench since 1991, “abused his judicial authority” by directing his staff and others at the courthouse to treat her harshly and intimidate her, according to a complaint she filed with Court Administrator Gary Yates last week.

After the affair ended, Olivier, who has worked for the court since 2002, was moved from Sage’s court to serve in a pool of court reporters, she alleges in the complaint obtained by The Enquirer on a public records request.

For Olivier, that meant making less money on transcripts that were ordered by attorneys on high-profile trials.

Olivier, who claims that she was involved in an average of 20 trials a year working for Sage, made about $50,000 in salary in 2011 and about $31,000 in transcript fees, according to payroll records obtained by The Enquirer.

Butler County common pleas judges decided in January to change their policy of having court reporters assigned to certain judges.

Olivier claims Sage is behind the change and that it was done to target her.

Judge Charles Pater, who is the administrative judge of Butler County Common Pleas Court, said in a prepared statement that he is having an independent investigator look into the allegations.

Pater said the investigator will “determine the truthfulness of the allegations and … make recommendations to the court.”

“The court will respond appropriately to the investigator’s findings and recommendations,” Pater said. (more…)

Ex-boyfriend of fired elections director pleads guilty

James Charles Schmidt Jr., who is the ex-boyfriend of former Butler County Elections Director Tippi Slaughter, pleaded guilty Tuesday to breaking and entering at the county board of elections office and a title office in Fairfield.

James Charles Schmidt Jr.Schmidt 45, pleaded guilty to two counts of breaking and entering and one count of possessing criminal tools. All three counts are fifth degree felonies, which individually can carry a punishment of 6-to-12 months in prison. No sentencing date has been set.

Meanwhile, Slaughter plead guilty last week to one felony charge of theft in office. She faces up to 18 months in prison and a $5,000 fine when she returns to Butler County Common Pleas Court on Sept. 21 for sentencing.

Slaughter, 47, was fired from her director position at the board of elections on June 23 and was charged with stealing $1,700 from the local Democratic Party when she served as its treasurer. She has since resigned from her treasurer position.
