West Chester hires away Butler Co. development director

West Chester Township is hiring away Butler County’s director of development, according to the Cincinnati Enquirer.

Michael Juengling is expected to be named the township’s community development director at Tuesday night’s trustee meeting, according to the meeting agenda. He would start the $75,000-a-year job on Dec. 1.

Butler County Commission President Chuck Furmon said Juengling submitted a letter of resignation last month.

In West Chester, Juengling would replace Brian Eliff, who left for a job as Symmes Township administrator in Hamilton County earlier this year.

Juengling, who lives in West Chester, told the Enquirer that he feels the job will be a good fit.

Tea Party hosts heated debate on Issue 2

Veterans Day in West Chester

Approximately 200-to-300 concerned citizens attended a passionate debate on Issue 2 between a state senator and an attorney representing Ohio’s firefighters at a local school in Liberty Township Monday night.

The highly publicized Issue, where each campaign committee has aired television ads featuring firefighters, is a petition-driven referendum to repeal Senate Bill 5, a collective bargaining overhaul that limited the ability of public workers to negotiate for wages, working conditions and pension benefits.

Steve Lazarus, an attorney representing the Ohio Association of Firefighters, spoke against the law and encouraged the community to vote “no” on Issue 2.

“I ask this question to myself because I don’t know the answer and I am going to ask the same question to you, how much is too much to pay someone who goes to work everyday and says to their spouse and children ‘goodbye’ and they may or may be coming home at the end of their shift?’” Lazarus said.

Speaking in favor of Issue 2 and in approval of Senate Bill 5, State Senator Bill Coley said the law gives city, township and school officials more tools when to comes to balancing their budgets during poor economic times.

“Local government has to get control over its budget and when there are step increases and automatic pay raises and things like that and you don’t have the control you need over your budget and you get into situations where you must raise taxes,” Coley said.

During the debate, Coley focused on how Issue 2 restores balance and fairness by asking government employees to pay 15 percent of their health insurance, 10 percent of their retirement and have pay raises be based on performance.

West Chester Township Trustee Catherine Stoker questioned Senate Bill 5 after the township has lost its local government funds, tangible personal property taxes and estate taxes.

“Issue 2 is supposed to recoup this five to six million dollars a year?

“By making them (government employees) pay their health premiums from 12 percent to 15 percent saves us a couple hundred grand a year,” Stoker said. “I am sorry, I don’t know how we are going to maintain our roads with this kind of math.”

Despite the event being sponsored by the Liberty Township Tea Party, the majority of the crowd appeared to be opposed to Issue 2 and often cheered on Lazarus.

“There is no reason to have collective bargaining if one side holds all the cards. It is a sham,” said Lazarus on Issue 2. “Why are we wasting our time with collective bargaining when one side gets to make the decision.”

Meanwhile, Coley argued that the current collective bargaining laws have to be changed and if Issue 2 is not passed then change will never happen.

“We changed the law so you the voters have the final say what is or is not fair. Those who oppose change want you to vote ‘no’ on Issue 2, so we can give that power back to labor lawyers,” Coley said. “We trust you, they don’t.”

Station Road Schoolhouse meeting to take place tonight

The West Chester Board of Trustees will meet with interested parties regarding a proposed lease agreement with the West Chester VFW Post7696 as manager/operator of the Station Road Schoolhouse Monday from 5 p.m. to 6 p.m.

In March, the board of trustees voted in favor of advertising for the request for proposals from a non-profit organization. Since then, the board has accepted proposals from non-profit organizations interested in operating and managing the schoolhouse building and property. The township itself would maintain ownership of the building.

According to the board, by selecting a qualified partner to operate and manage the schoolhouse, costs to township would be reduced and the building would be preserved.

The two-room schoolhouse on Station Road was built in the early 1900s on the foundation of a one-room schoolhouse that was destroyed by fire. The two-room schoolhouse served the community until 1916 when the Union Township Centralized School (now Union Day School) was built on Cincinnati-Dayton Road. The building features two large rooms divided by pocket doors, an entry foyer and restroom.

The Station Road Schoolhouse is located at 6670 Station Road.

West Chester Board of Trustees alter meeting schedule

The West Chester Township Board of Trustees, which will meet Tuesday at 6 p.m., has altered its November and December meeting schedule to accommodate the holiday season.

The trustees first voted to alter its schedule during its Aug. 23 board meeting. Previous meetings that were scheduled for Nov. 8, Nov. 22, Dec. 13 and Dec. 27 have been canceled.

The board of trustees will now meet once in November and twice in December at its regular 6 p.m. meeting time. Meeting dates will be Nov. 15, Dec. 6 and Dec. 20.

In October, the board of trustees will continue to meet at its regularly scheduled meetings on the second and fourth Tuesdays in October (Oct. 11, 25).

The West Chester Township Board of Trustees meets in Township Hall, 9113 Cincinnati-Dayton Road and meetings are open to the public. The public is offered opportunities to speak at the meetings during designated times in the agenda.

West Chester Township candidates to be at The Cone Sept. 14

West Chester Township Fiscal Officer candidate Chris Xeil Lyons and West Chester Township Trustee George Lang will be at The Cone Wednesday, Sept. 14, from 6 p.m. to 8 p.m. The candidates will be there to meet with constituents and answer questions. They will also be providing free cones for all kids in attendance.

Chris Xeil Lyons Lyons, 37, is seeking to fill the seat that is being vacated by West Chester Township Fiscal Officer Pat Williams, who is serving her final term in office.

“I have launched my campaign for fiscal officer to ensure that West Chester Township maintains a budget that is fiscally responsible, and allows us to continue providing necessary services to Township residents and businesses,” Lyons said. “I will work hard to improve communications with citizens and businesses utilizing social media, email lists and newspaper columns. I committed to making certain that West Chester remains a place where families grow and businesses prosper.”

Other candidates running for fiscal officer include Christy Miller, Bruce Jones, Kerry Hendel and Mark Toney.

Meanwhile, Lang was first elected in November of 2003. He is seeking his third term.

He is running against Mark Welch, William Zerkle and Anthony Klimek.

The Cone is located at 6855 Tylersville Road in West Chester.

West Chester Township officially prohibits Internet cafes

At tonight’s meeting, the West Chester Township Board of Trustees officially approved previously proposed text amendments that prohibit Internet sweepstakes establishments (otherwise known as Internet cafes) from setting up in the township.

The amendments also further define the proximity to the street and the type of signage that would be permitted by sexually-oriented businesses electing to move into West Chester.

“It is right for us to look at ways to keep the township vibrant,” trustee George Lang said during the first vote on the amendments in June. “All of these businesses are constitutionally protected and we just want eliminate the impact that these businesses can have on our community.”

The board’s vote Tuesday was the final one needed to pass the text amendments. The actual effective date will be in 30 days.

When the text amendments were first presented to the board during a work session May 24, attorney Scott D. Phillips of the Frost Brown Todd law firm recommended that the board vote to prohibit any Internet sweepstakes establishments in West Chester.

Phillips described Internet cafes (not to be confused with coffee shops or restaurants that provide the Internet) with the “look and the feel of a small casino.”

The attorney said that customers, at a particular Internet sweepstakes establishment, were able to purchase a phone card worth $5 to $50. Then those customers could swipe those cards at computer terminals to play games, such as poker, slot-machine type gaming and tic-tac-toe.

“If you win, the balance goes up and if you lose the balance goes down,” Phillips said.

Phillips described the use of phone cards as a way these companies are trying to avoid gambling laws.

Another part of the zoning text amendments also concerned sexually-oriented businesses.

Currently, the law permits these types of businesses to be located in a defined a geographic area, which is south of Port Union Railto Road and west of State Route 747.

This proposed amendment will make those types of businesses to be located at least 150 feet back from the main street and put defined the type of signage that will be permitted for these business.

BOARD CHANGES MEETING SCHEDULE: The board of trustees also decided to adjust its meeting schedule. Previous meetings scheduled for Nov. 8, Nov. 22, Dec. 13 and Dec. 27 have been canceled. Due to the election taking place and people having to vote at Township Hall, the board will be unable to meet Nov. 8. The board is now scheduled to meet Nov. 15, Dec. 6 and Dec. 20.

West Chester trustees appoint first human resources director

The West Chester Township Board of Trustees approved the appointment of Brenda Jackson to the position of human resources director during their public meeting Tuesday. Jackson, who is a life-long resident of West Chester, is the first human resources director for the township.

“As an organization, West Chester’s operations are complex and employment issues arise that are indicative of any organization with several collective bargaining units and 333 full and part-time employees,” Township Administrator Judi Boyko said in a release.

“It will serve the community’s interests more cost effectively to include in our operations an expert in the areas of personnel, compliance with federal regulations, etc.”

According to a release provided by the township, Jackson served as global director of corporate human resources for an international manufacturing company and as a human resources consultant in the retail, consumer products, manufacturing, distribution and services industry.

Jackson also attended Hopewell and Union elementary schools before graduating from Lakota High School and Wilmington College.

The human resources director will work directly under the supervision of Boyko and will supervise the administration of payroll and employee benefits processes and programs.

Jackson will be paid the annual salary of $69,800 with a one-year probationary period and contingent upon successful completion of applicable testing and procedures and pursuant to the terms of employment.

Trustees approve 2011 merit raises up to four percent

The West Chester Township Board of Trustees approved and authorized its township administrator to give merit raises up to four percent to all qualified non-contract exempt and non-exempt employees at its meeting Tuesday, June 28.

The raises can be authorized in the first full-pay period in July and includes a 3-mill increase to the payment pool for non-contract employees.

The merit-based system was originally approved by the trustees in Feb. 2006 and only awards raises to employees, who are considered “top performers.”

West Chester Township, unlike other communities, does not offer step-pay increases.

The board passed the motion for merit raises up to four percent on Tuesday by way of a 2-to-1 vote.

Trustee George Lang opposed the raises and showed concern that the decrease in the local government fund, decreasing property taxes and the recent loss of local businesses could cause a “perfect storm for negativity for local government finances.”

“The private sector has to support the government,” Lang said. “If we continue to allow government to grow, as the private sector downsizes – it is an unsustainable formula. I would just recommend that we take a year off for pay raises for our non-contract employees.”

Meanwhile, fellow trustees Catherine Stoker and Lee Wong shared their appreciation for the merit-based program and believe the township needs to “incentivize” its non-contract employees.

“I think that it is important that we keep our employees innovative and sharp and constantly looking to do better,” Stoker said. “We can’t just beat them with a stick and say ‘no, we are not going to do anything.’”

The Villages at the Streets of West Chester begins construction on townhomes

The Villages at the Streets of West Chester, a condominium development that has been stalled due to the economic downturn, is officially under construction.

The permits for the first group of townhomes (six dwelling units) were recently issued and construction began last week by Ryan Homes. Overall, there will be 60 townhome units (12 building) built in the development. Each townhome is expected to sell in the low $200,000’s.

cindc5-5z13gz7bnvcof0cmmyp_originalThe preliminary development plan also approved 256 stacked condo units (16 buildings). In total, the entire project is expected to contain 316 total dwelling units in the retail complex located off Interstate 75.

“This project has been an important component in the long-term development and success of The Streets of West Chester commercial area,” West Chester Township trustee George Lang said. “This urban mixing of residential and commercial is important to help our businesses thrive.”

At the latest West Chester Township Board of Trustees meeting, Lang and his fellow board members approved an agreement for the use of tax increment financing not to exceed $500,000 for public improvements to the Villages at the Streets of West Chester.

Improvements that are eligible per that agreement, which have been limited to the street right-of-ways and designated easement areas, include pedestrian pathways (sidewalks and bike paths), street lights, landscaping (including street trees), irrigation system (including fountains, wells and pumps), decorative entrance walls (including wall lighting) and hardscape features and fixtures.

“Due to the economic turndown, this project has been stalled,” Lang said. “It is great for West Chester to see developers now moving forward on this project, further defining the Union Centre area as West Chester’s downtown … This will ultimately lead to greater profits for those businesses, who have invested in our community, and allow them a better opportunity to flourish and prosper.”

Board of Trustees could prohibit Internet cafes

Attorney Scott D. Phillips of the Frost Brown Todd law firm recommended during a work session on Tuesday, May 24, that the West Chester Township Board of Trustees vote to prohibit any Internet sweepstakes establishments (otherwise known as Internet cafes) from setting up in the township.

Phillips and professor Alan Weinstein of Cleveland State University were among the guests who presented proposed zoning text amendments in the areas of sexually oriented businesses, Internet cafes (not to be confused with coffee shops or restaurants that provide the Internet) and other related zoning issues.

Phillips described Internet cafes with the “look and the feel of a small casino.”

In February, the board agreed to enact a moratorium on Internet cafes. That moratorium postponed those types of businesses from entering the township for a six-month period. The board is scheduled to lift the moratorium in August.

The board did discuss the proposed zoning text amendments, including Internet cafes, at Tuesday’s meeting and will likely vote on the amendments at the next board meeting, which is scheduled for June 14 at 6 p.m.

Part of the zoning text amendments also concerned sexually oriented businesses. This proposed amendment will make those types of businesses to be located at least 150 feet back from 747 or Port Union Road. Meaning that any tenant with this type of business will not be allowed to be located along the main street. There are also two zones where sexually oriented businesses can be located in the township. One zone is located off Commercial Drive near 747 and the other is around the intersection of 747 and Port Union Road.
